SALES ITEMS

Art in Clay’s online show & shop act as a facilitator for customers to purchase items that would be available at our physical show from our exhibitors. The agreements in terms of purchasing an item is directly with the exhibitor and once the purchase has taken place if there are any issues with the product purchased then Art in Clay will facilitate the communication with the exhibitor.

Items promoted on this website within the online shop area are exclusively available to Art in Clay and form part of the online show.  Items will be available to purchase from 5pm on Thursday 11th June 2020 until Monday 31st August 2020.

Exhibitors hold the rights to remove items that are being promoted for sale at any point during the show and can request for them to be removed.

The product sale, delivery, return & refund is the sole responsibility of the exhibitor and they must ensure that the product is dispatched and that the purchaser receives the goods within 14 days. Art In Clay will not be made liable.

 

CONSUMER RIGHTS

LoveClay Ltd T/A Art in Clay is a UK based company and complies with UK consumer law including the Distance Selling Regulations; our Terms & Conditions do not affect your statutory rights. Distance Selling Regulations give you the right to cancel an order and return any goods that may already have been dispatched, up to 14 days from receipt.

 

 

DESCRIPTIONS & SPECIFICATIONS 

Art in Clay makes no representation as to the quality or performance or suitability for the Buyer’s purposes. The Seller provides no performance warranties whatsoever.

All descriptions, specifications, drawings and illustrations contained on the website and advertising matter and similar information given verbally is published for general guidance only and no warranty or guarantee of any is to be implied by such publication nor is such information to form part of any contract.

In accordance with our exhibitors wanting to remove products we reserve the right to change specifications or delete any item from our website or other sales literature without prior notice.

 

REFUNDS & RETURNS

If it should be necessary to return goods, a request should be made in writing stating the order number, the quantity and description of the goods and the reason for the proposed return. No shipment should be made until written authorisation is received.

Customers have 14 days from delivery to notify Art in Clay if they wish to return their purchased item and receive a refund, the item that has been purchased via this website will need to be returned directly to the exhibitor. Once we have been notified we will then clarify the return address and once the item has been received by the exhibitor undamaged then the exhibitor will arrange a direct refund.

 

AVAILABILITY & DELIVERY

Art in Clay is a facilitator for the sales of ceramic items via the Art in Clay website and the exhibitor is responsible for dispatching the items directly to the customer, please allow 14 days to receive your goods. Once an item has been purchased then Art in Clay will liaise with the relevant exhibitor to ensure your items is dispatched as soon as possible by confirming payment.

Delivery is therefore the responsibility of the exhibitor and Art in Clay is not liable. If there are any issues with delivery Art in Clay will ensure that the customers is put in direct contact with the exhibitor who are aware and have agreed to the liability of purchase.

Art in Clay recommends that the exhibitor ensures they obtain delivery insurance to cover any damages during transport of the product, Art in Clay is not liable for any damage during delivery.

If a customer is based outside of the UK please proceed with your purchase and the relevant exhibitor will be in touch to confirm the additional monies needed to ship the item outside of the UK. If a customer wishes for this to be clarified prior to purchase please get in touch via info@artinclay.co.uk 

Force Majeure – our exhibitors shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including without limitation, strikes, lockouts and other industrial disputes.)

 

CARD PAYMENTS, SECURITY & PRIVACY

We accept most major credit cards. Exchange rates around the world do vary all the time so payments made to Art in Clay must always be in UK pounds Sterling.

We can assure you that all your information is kept safe and secure, from your online shopping basket to the goods arriving at your front door. Relevant information will be sent directly to the exhibitor to ensure that delivery can take place, any other details provided by the customer will not be shared. A secure SSL encryption protects all your details during the shopping process and we do not pass on or use them with any third parties, companies and marketing organisations. All the details required are needed for no other reason than to fully process your order.

Items available on this website have been provided by the exhibitor and Art in Clay has been given permission to promote the sale of these items. Thus the stock is dictated by our exhibitors. If an item is out of stock it will be displayed as such on the site. If there is a problem with availability we will contact you within 24 hours of the order being made, in which case you have a choice of waiting until it is in stock. In any case, orders are not processed unless we have the item in stock.

Art in Clay regularly monitors our website content and reserve the right to remove or edit content at any time. Material submitted to our website including images are copyright protected and Art in Clay has been permitted by an exhibitor for its use.

LoveClay Ltd t/a Art in Clay disclaims damages of any kind, compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties implied or otherwise relating to use of this site. All pictures, material, code, intellectual property and descriptions are the property of Art in Clay. All images representing our exhibitors and their products are the property of the exhibitor. It may not be copied or used without the express permission of these parties.

 

USER COMMUNICATIONS

By inputting data or engaging in any other form of communication (individually or collectively “Communications”) to or within the Website, you grant to Art in Clay a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty-free license to use (including use for promotional and advertising purposes), copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit and otherwise exploit such Communications and any ideas or materials contained in such Communications, in all media now known or hereafter developed. CHOICE OF LAW; JURISDICTION

These Terms of Use (including our Privacy Policy, Delivery & Returns, Exhibitor Online Show Information and any other documents or policies appearing on the Website) constitute the entire agreement between you and Art in Clay with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. The section headings used herein are for convenience only and shall not be given any legal import.
